#Overview

All NGOs who intend to undertake any CSR activity are required to register themselves by filing E-form CSR-1 to the Ministry of Corporate Affairs (MCA). From April 01st, 2021, the government made it mandatory for all NGOs before taking any CSR funds for CSR activities. All the registration processes are governed under Section 135 of the Companies Act, 2013, and Companies (Social Responsibility Policy) Rules, 2014.

#1. Who is eligible for the filing Form CSR-1?

The NGOs below are eligible to submit form CSR-1 to the MCA only if they have a 3-year track record in undertaking CSR activities and are registered under 12A and 80G of the Income Tax Act, 1961.

  • Section 8 Company (Registered under the Companies Act)
  • Society (Registered under the Society Act)
  • Public Trust (Registered under the Trust Act)
  • Any section 8/trust/society established by the Government.

  • Copy of registration certificate of NGO
  • Copy of PAN of NGO
  • Official e-mail ID and Contact number of NGO

#5. What is the procedure for filing the form CSR-1?

The procedure for filing the form CSR-1 is as follows:

  • Step: 1 Create an account (V2) as a business user on the MCA website (www.mca.gov.in) by filling in the company details like name, address, CIN, PAN, mobile number, email ID, etc., and create a user ID and password.
  • Step: 2 Log in to the MCA portal with their created user ID and password, after logging in, click the forms and download top of the site then from the list of forms select the form – CSR -1 (Registration of entities for undertaking CSR Activities)
  • Step: 3 After clicking on Form CSR-1 Download the form and the Form CSR-1 will appear for filling purposes.
  • Step: 4 After filling out Form CSR-1 applicant proceeded to affix digital signature purposes.
  • Step: 5 At last affix the digital signature of any one director/member/trustee/etc. of the entity and a practicing professional (CS/CA/CMA) then submit/upload to the same and a challan will be created and there is Zero govt. fee.
  • Step: 6 Within 1 working day, a CSR certificate will be generated and the same will come through e-mail to the NGOs e-mail.
